Dangerous Substance Licence

Under the Dangerous Substances Act 1972 and 1979 a license is required to use dangerous substances.

Anywhere there are dangerous substances stored a licence is required under the Dangerous Substances Regulations (1979). The most common substance requiring licensing is petrol and petroleum products.

This licence is granted by the Fire Authority following a formal application and payment of the relevant fee.

To apply for a Dangerous Substances licence, the following details are required:

  • 3 x Copies of the Ordnance Survey extract showing the location of the development
  • 3 x Copies of a site plan (to a scale of not less than 1:100) showing the position of underground tanks, pipelines and dispensing pumps as well as all buildings. The plans should detail the amounts of petroleum Class 1 to be kept in underground tanks & storage areas, any building/retail area/private store where materials other than Class 1 substances will be stored which are liable to spontaneous combustion, ignition or are otherwise flammable.
  • 3 x Copies of the elevations/sections/floor plans of the tanks and buildings
  • 3 x Copies of specifications/appropriate particulars showing all electrical apparatus installed.

For each application for an amended licence, the following is required:

  • One plan or specification or appropriate particulars (with 3 copies) giving details of the proposed installation, alteration, enlargement, addition or reconstruction
  • Any further particulars, plans, maps or drawings which the licensing authority requires by notice in writing

Licence Fees

The following fees apply:

  • in case such storage capacity exceeds 500 litres but does not exceed 2,500 litres, €7.60
  • in case such storage capacity exceeds 2,500 litres but does not exceed 5,000 litres, €11.40
  • in case such storage capacity exceeds 5,000 litres but does not exceed 25,000 litres, €15.20
  • in case such storage capacity exceeds 25,000 litres but does not exceed 50,000 litres, €30.40
  • in case such storage capacity exceeds 50,000 litres but does not exceed 100,000 litres, €45.60
  • in case such storage capacity exceeds 100,000 litres but does not exceed 250,000 litres, €70.40
  • on the transfer or replacement of the licence €3.80
